EARTHTRAN GLOBAL LIMOUSINE SERVICE

TERMS & CONDITIONS AND TRANSPORTATION SERVICE AGREEMENT

1. ACCEPTANCE OF TERMS

These Terms and Conditions constitute an agreement between EarthTran Global Limousine and Transportation Service Inc., referred to throughout these Terms as “EarthTran Global Limousine,” “EarthTran,” “we,” “our,” or “us,” and the person or organization making the reservation, referred to as the “Client,” “Customer,” “Passenger,” “you,” or “your.” By making a reservation, approving a quote, signing a contract, submitting payment, providing a credit or debit card, clicking an online acceptance button, or using transportation services provided by EarthTran, the Client acknowledges that the Client has read, understood, accepted, and agreed to these Terms and Conditions. The person making a reservation on behalf of a company, organization, group, family, or other passengers represents that he or she has authority to accept these Terms on behalf of the party responsible for payment. These Terms apply to all transportation services provided by EarthTran, including but not limited to:
  • Airport transportation
  • Point-to-point transportation
  • Hourly limousine service
  • Black car service
  • Sedan and SUV service
  • Sprinter van service
  • Bus and group transportation
  • Corporate transportation
  • Wedding transportation
  • Prom transportation
  • Special-event transportation
  • Charter transportation
  • Roadshows
  • Concert and sporting-event transportation
  • Bride and groom getaway transportation
  • Other chauffeured transportation services
A separate signed agreement, reservation confirmation, or event contract may contain additional terms. If a specific written contract contains terms that differ from these general Terms and Conditions, the specific written contract will control for that reservation to the extent permitted by law.

2. RESERVATIONS

All reservations are subject to vehicle and chauffeur availability. A reservation is not guaranteed until EarthTran has accepted the reservation and any required deposit, payment, or payment authorization has been received. The Client is responsible for providing complete and accurate reservation information, including:
  • Passenger name
  • Contact telephone number
  • Email address
  • Pickup date
  • Pickup time
  • Pickup address
  • Destination
  • Flight number when applicable
  • Airline when applicable
  • Passenger count
  • Number and size of luggage pieces
  • Vehicle requirements
  • Child safety-seat requests
  • Scheduled stops
  • Special instructions
  • Accessibility requirements
  • Event itinerary
EarthTran is not responsible for delays, missed pickups, incorrect routing, or other problems resulting from inaccurate, incomplete, or outdated information supplied by the Client. The Client should immediately notify EarthTran of any change to the reservation.

3. PRICING

Reservation pricing is based on the information available when the reservation is confirmed. Rates may vary based on:
  • Vehicle type
  • Service type
  • Pickup and destination
  • Number of hours
  • Travel distance
  • Date
  • Time
  • Demand
  • Special events
  • Additional stops
  • Waiting time
  • Parking
  • Tolls
  • Airport charges
  • Required permits
  • Requested amenities
  • Other reservation requirements
The confirmed price applies to the itinerary originally booked. Changes to the itinerary or service may result in additional charges.

4. STANDARD GRATUITY

A 20% standard gratuity is included in online reservations, unless otherwise stated on the reservation confirmation, quote, or written contract. Any additional gratuity voluntarily provided by the Client is at the Client’s discretion.

5. DEPOSITS AND ADVANCE PAYMENTS

Certain reservations may require a deposit, partial payment, or full advance payment to secure the requested vehicle or service. Any amount collected will be applied toward the total reservation price unless specifically identified as a separate booking, permit, or third-party fee. Unless a separate event or transportation contract expressly provides otherwise, cancellation and rescheduling of deposits and advance payments will be handled according to the cancellation and rescheduling provisions contained in these Terms. Special-order expenses, permits, venue charges, parking reservations, subcontractor charges, accommodations, or other non-recoverable expenses specifically incurred for the Client may remain non-refundable.

6. PAYMENT AUTHORIZATION

By providing EarthTran with a credit card, debit card, or other payment method, the Client authorizes EarthTran to charge the payment method for amounts properly due under the reservation and these Terms. This may include:
  • Reservation price
  • Required deposits
  • Cancellation fees
  • Waiting time
  • Overtime
  • Additional stops
  • Requested itinerary changes
  • Additional service
  • Parking
  • Tolls
  • Airport fees
  • Cleaning charges
  • Smoking charges
  • Property or vehicle damage
  • Excessive cleanup
  • Approved upgrades
  • Other charges incurred in connection with the reservation
The Client represents that he or she is authorized to use the payment method provided. EarthTran may request additional identity or payment verification when reasonably necessary to prevent fraud.

CANCELLATIONS, RESCHEDULING & TRAVEL CREDIT

7. STANDARD 25% CANCELLATION FEE

Unless a separate signed contract expressly states a different cancellation policy, a Client who chooses to cancel a confirmed reservation is subject to a cancellation fee equal to 25% of the total reservation price.

Example:

If the total reservation price is: $1,000.00 The 25% cancellation fee would be: $250.00 If EarthTran has already collected payment, EarthTran may deduct the applicable 25% cancellation fee from the amount paid. Any remaining eligible balance may be refunded to the original payment method, subject to any non-recoverable costs specifically incurred for the reservation. If the amount previously collected is less than the applicable 25% cancellation fee, the Client authorizes EarthTran to charge the payment method on file for the remaining amount due.

8. RESCHEDULE YOUR TRIP AND WAIVE THE 25% CANCELLATION FEE

EarthTran understands that travel plans, meetings, weddings, flights, and special events may change. Instead of cancelling the reservation and paying the 25% cancellation fee, the Client may request to reschedule the transportation with EarthTran Global Limousine.

If the Client chooses to reschedule:

THE 25% CANCELLATION FEE WILL BE WAIVED. Eligible amounts already paid will be converted to an:

EARTHTRAN TRAVEL CREDIT / STORE CREDIT

The travel credit may then be applied toward a future transportation reservation with EarthTran Global Limousine. This allows the Client to keep the value of eligible payments with EarthTran instead of losing 25% of the reservation price to a cancellation fee.

9. TRAVEL CREDIT / STORE CREDIT TERMS

When the Client selects the rescheduling option:
  • The 25% standard cancellation fee is waived.
  • Eligible payments already received are retained as EarthTran Travel Credit / Store Credit.
  • The credit can only be used for transportation provided by EarthTran Global Limousine.
  • The credit has no cash redemption value.
  • The credit cannot be exchanged for cash.
  • Once a Client voluntarily selects travel credit instead of cancellation and refund, the credit is not refundable to the original payment method.
  • The credit is subject to future vehicle availability.
  • The new reservation is subject to EarthTran’s rates in effect when the new trip is booked.
  • If the new reservation costs more than the available credit, the Client must pay the difference.
  • If the new reservation costs less than the available credit, any treatment of the remaining balance will be determined by EarthTran and communicated at the time of rescheduling.
  • Any expiration or special restriction applicable to a particular credit will be disclosed in writing when the credit is issued.
  • Travel credit cannot be converted into gratuity, cash, or a payment to another transportation provider.
  • EarthTran may require the original Client or authorized representative to make the rescheduled reservation.
A travel-credit request must be made before the scheduled transportation service has begun. Once transportation has started, the reservation cannot be converted into travel credit.

10. COSTS ALREADY INCURRED

Waiving the 25% cancellation fee through rescheduling does not necessarily waive third-party or non-recoverable costs already incurred specifically for the Client. Examples may include:
  • Special permits
  • Prepaid parking
  • Event permits
  • Chauffeur lodging
  • Special vehicle positioning
  • Subcontractor cancellation charges
  • Special-order amenities
  • Other non-recoverable expenses
EarthTran will make reasonable efforts to notify the Client if such charges apply.

11. REPEATED RESCHEDULING

EarthTran reserves the right to limit repeated rescheduling of the same reservation when repeated changes create unreasonable operational costs or prevent EarthTran from accepting other reservations. Any special restriction will be communicated to the Client.

12. NO CALL / NO SHOW

A No Call / No Show occurs when the Client or passengers fail to appear for transportation and do not properly contact EarthTran within the applicable waiting period. No Call / No Show reservations may be charged 100% of the total reservation price. No Call / No Show reservations are:
  • Non-refundable
  • Not subject to the standard 25% cancellation fee
  • Not automatically eligible for travel credit
  • Not automatically eligible for rescheduling
EarthTran may make exceptions in extraordinary circumstances at its discretion, but is not required to do so.

13. CANCELLATION BY EARTHTRAN

If EarthTran is unable to provide the contracted transportation and is unable to provide a reasonable substitute, EarthTran may issue an appropriate refund or travel credit for transportation that was not provided. Any remedy will depend on the circumstances and applicable law.

AIRPORT TRANSPORTATION

14. AIRPORT TRANSFERS

Airport transportation may require full payment when the reservation is confirmed. Unless otherwise specified in a written reservation confirmation or separate contract, airport reservations are subject to the standard: 25% Cancellation Fee or Reschedule With EarthTran and Waive the 25% Cancellation Fee policy described above. Clients are strongly encouraged to provide correct:
  • Airline
  • Flight number
  • Arrival airport
  • Arrival date
  • Scheduled arrival time
  • Passenger telephone number
EarthTran may use available flight information to monitor a flight, but the Client remains responsible for notifying EarthTran about major itinerary changes when reasonably possible.

15. FLIGHT DELAYS

When valid flight information has been provided, EarthTran will make reasonable efforts to adjust airport pickup service based on flight delays. Vehicle and chauffeur availability may affect our ability to accommodate major changes. A change of airport, flight, airline, destination, passenger count, or substantially different arrival date may require a reservation modification and additional charges.

16. AIRPORT WAITING TIME

EarthTran generally allows up to 60 minutes of complimentary waiting time for airport pickups, unless the reservation confirmation states otherwise. Waiting time beyond the complimentary period may result in additional charges based on the applicable vehicle rate. Airport pickup procedures may vary based on:
  • Airport
  • Terminal
  • International or domestic arrival
  • Airport regulations
  • Meet-and-greet arrangements
  • Baggage delays
  • Customs and immigration processing
Passengers should maintain communication with EarthTran when unexpected delays occur.

CHILD SAFETY SEATS / CAR SEATS

17. CHILD SAFETY SEAT POLICY

EarthTran Global Limousine may provide a child safety seat or booster seat when requested in advance and when availability has been confirmed. Clients may also provide their own child safety seat. A request for a child seat does not guarantee availability unless EarthTran confirms the request.

IMPORTANT — CLIENT RESPONSIBILITY FOR INSTALLATION

EarthTran Global Limousine Service and its chauffeurs do NOT install child safety seats or booster seats. The parent, legal guardian, or responsible adult traveling with the child is solely responsible for installing the child safety seat, inspecting its installation, adjusting the seat, securing the child, and properly using the child restraint system. This policy applies whether the child safety seat is:
  • Provided by EarthTran;
  • Rented or supplied through another company; or
  • Personally owned and provided by the Client.

The parent, guardian, or responsible adult is responsible for:

  • Determining whether a child safety seat or booster seat is legally required.
  • Selecting the correct type of seat for the child.
  • Determining whether the seat is appropriate for the child’s age, height, and weight.
  • Reading and following the child-seat manufacturer’s instructions.
  • Installing the seat in the vehicle.
  • Checking that the seat is properly secured.
  • Positioning the child correctly.
  • Adjusting the harness or restraint system.
  • Buckling and securing the child.
  • Rechecking the installation as necessary during the trip.
  • Ensuring compliance with applicable child-passenger safety requirements.

Chauffeurs Do Not Install or Certify Child Seats

EarthTran chauffeurs are transportation professionals and are not acting as certified child passenger safety-seat installers or inspectors. A chauffeur may provide reasonable access to available:
  • Seat belts
  • LATCH anchors
  • Vehicle seating positions
  • Other manufacturer-installed restraint equipment
However, providing access or pointing out available equipment does not constitute:
  • Installation
  • Inspection
  • Certification
  • Approval
  • Verification
  • A representation that the child seat is properly installed
The Client must make the final determination that the child safety seat is properly installed and that the child is properly secured before transportation begins.

18. CHILD SEAT PROVIDED BY EARTHTRAN

When EarthTran supplies a child safety seat, EarthTran is supplying the equipment for the Client’s use. Providing the child seat does not mean that EarthTran or the chauffeur will install the seat. Before using an EarthTran-provided seat, the parent, guardian, or responsible adult should inspect it and determine that it is suitable for the child and acceptable for use. If the Client believes the seat is damaged, unsuitable, or otherwise should not be used, the Client should notify the chauffeur immediately and should not use the seat.

19. VEHICLE WILL NOT DEPART UNTIL CHILD IS SECURED

When a child safety seat is required or requested, EarthTran may delay departure until the responsible adult confirms that:
  • The child safety seat has been installed;
  • The responsible adult is satisfied with the installation; and
  • The child has been properly secured.
EarthTran reserves the right to refuse or discontinue transportation when a responsible adult refuses to properly secure a child or when continuing transportation would violate applicable law or create an unreasonable safety risk. No chauffeur is required to install a child safety seat in order for a trip to proceed.

20. CHILD-SEAT LIABILITY

To the maximum extent permitted by applicable law, the Client accepts responsibility for claims, injuries, losses, or damages arising from the Client’s improper selection, installation, adjustment, securing, or use of a child safety seat or booster seat. EarthTran Global Limousine and its chauffeurs are not responsible for the Client’s installation of a child safety seat or booster seat. Nothing in this provision is intended to waive or limit any responsibility that cannot legally be waived under applicable law.

HOURLY & CHARTER SERVICES

21. MINIMUM HOURS

Hourly limousine, SUV, sedan, Sprinter, bus, and charter services may be subject to a minimum booking period. The applicable minimum will be disclosed when the reservation is booked. By confirming an hourly reservation, the Client agrees to pay for the full minimum service period even if the Client uses the vehicle for less time. Unused reserved time is non-refundable.

22. GARAGE-TO-GARAGE BILLING

Hourly and charter reservations may be billed on a garage-to-garage basis. This means billable time may begin when the vehicle leaves EarthTran’s base, garage, staging location, or assigned operating point and may continue until the vehicle returns. Billable time is not necessarily limited to the period when passengers are physically inside the vehicle. Service time may include:
  • Travel to the pickup
  • Vehicle positioning
  • Passenger loading
  • Waiting
  • Transportation
  • Scheduled stops
  • Event standby
  • Return travel
By booking hourly transportation, the Client acknowledges and accepts the applicable billing method.

23. OVERTIME

Transportation that continues beyond the scheduled reservation period is considered overtime. Overtime may be billed in 30-minute increments based on the applicable vehicle’s hourly rate. The Client authorizes EarthTran to charge the payment method on file for applicable overtime. EarthTran cannot guarantee vehicle availability beyond the originally contracted reservation period. If the vehicle has another scheduled reservation, the chauffeur may be required to end service at the contracted completion time.

WEDDING TRANSPORTATION

24. BRIDE & GROOM GETAWAY CAR SERVICE

Qualifying luxury sedan and SUV bride-and-groom getaway transportation may have a two-hour minimum, unless otherwise stated in the reservation confirmation. The service may include up to one hour of waiting time when specifically included in the reservation. Additional stops, extended waiting, route changes, or additional service may result in additional charges. Wedding transportation involving:
  • Multiple vehicles
  • Limousines
  • Sprinter vans
  • Buses
  • Guest shuttles
  • Multiple locations
  • Long-distance transportation
  • Extensive waiting time
may require a separate wedding transportation agreement.

WAITING TIME

25. NON-AIRPORT WAITING TIME

EarthTran generally provides up to 15 minutes of complimentary waiting time for residential, business, office, hotel, and other non-airport pickups unless otherwise specified. Waiting time beyond the complimentary period may be charged at the applicable vehicle rate.

26. PASSENGER DELAYS

The Client is responsible for being ready at the scheduled pickup time. A passenger delay does not automatically extend the scheduled completion time of an hourly reservation. If the Client requests additional time and EarthTran can accommodate the request, overtime charges may apply.

ITINERARY CHANGES

27. ADDITIONAL STOPS

The reservation price is based on the agreed itinerary. Additional charges may apply when the Client requests:
  • Additional stops
  • Additional pickups
  • Additional drop-offs
  • Significant route changes
  • Extended waiting
  • Destination changes
The chauffeur may decline an unscheduled change when the change would create a safety concern, violate applicable law, exceed operating limits, or interfere with another scheduled reservation.

28. DIFFERENT FINAL DROP-OFF

If the final drop-off location is substantially different from the destination originally reserved, additional charges may apply.

PARKING, TOLLS & OTHER FEES

29. PARKING AND TOLLS

Unless expressly included in the confirmed rate, parking charges, tolls, road-use charges, permits, airport access fees, venue charges, and similar costs may be added to the reservation.

30. TAXES

Applicable sales taxes, transportation taxes, government fees, and other mandatory charges may be added where required. If taxes have already been included in the quoted price, they will not be charged a second time.

PASSENGER CONDUCT

31. ALCOHOL

No person under the legal drinking age may consume alcoholic beverages in an EarthTran vehicle. Violation may result in immediate termination of transportation without refund. All passengers are responsible for complying with applicable alcohol laws.

32. NO SMOKING

Smoking is prohibited in EarthTran vehicles. A $150 smoking cleaning fee per incident may be charged. Additional charges may apply when smoking results in:
  • Burns
  • Permanent odor
  • Upholstery damage
  • Carpet damage
  • Professional deodorizing
  • Specialized cleaning
  • Vehicle downtime
  • Other damage

33. VAPING

EarthTran may prohibit vaping or electronic smoking devices inside its vehicles in the same manner as traditional smoking. The Client and passengers must comply with chauffeur instructions regarding smoking and vaping.

34. ILLEGAL DRUGS

Illegal drugs and illegal drug activity are prohibited in all EarthTran vehicles. A violation may result in immediate termination of transportation without refund.

35. ILLEGAL ACTIVITY

No passenger may use an EarthTran vehicle to engage in unlawful conduct. EarthTran and its chauffeurs reserve the right to terminate service when there is a reasonable safety or legal concern.

36. DISRUPTIVE OR DANGEROUS PASSENGERS

Passengers who are:
  • Violent
  • Threatening
  • Abusive
  • Destructive
  • Excessively disruptive
  • Harassing
  • Engaged in illegal conduct
  • Creating a serious safety hazard
may be removed from the vehicle or have transportation terminated at EarthTran’s or the chauffeur’s discretion. No refund will be provided when service is terminated because of passenger misconduct.

CLEANING & DAMAGE

37. VOMIT / BIOHAZARD CLEANING

A minimum $200 cleaning surcharge may be assessed for a vomiting incident. Additional charges may apply if the incident requires:
  • Professional detailing
  • Biohazard cleaning
  • Seat removal
  • Carpet cleaning
  • Odor treatment
  • Repair
  • Replacement
  • Vehicle downtime
The Client responsible for the reservation is responsible for charges resulting from members of the Client’s party.

38. EXCESSIVE CLEANING

Additional cleaning charges may also apply for excessive messes involving:
  • Food
  • Beverages
  • Mud
  • Glitter
  • Confetti
  • Bodily fluids
  • Excessive trash
  • Other unusual contamination
Normal use of a vehicle is not considered excessive cleaning.

39. VEHICLE DAMAGE

The Client accepts financial responsibility for damage caused to the vehicle by the Client or any member of the Client’s party. Charges may include reasonable costs for:
  • Repair
  • Replacement
  • Cleaning
  • Restoration
  • Parts
  • Labor
  • Towing
  • Vehicle downtime
  • Other expenses reasonably related to the damage
EarthTran may document damage using photographs, video, chauffeur reports, repair estimates, invoices, or other records.

LOST OR DAMAGED PROPERTY

40. PERSONAL PROPERTY

EarthTran is not responsible for personal property that is left, lost, misplaced, stolen, or damaged in a vehicle, except to the extent otherwise required by law. Passengers should inspect the vehicle before leaving at the end of the trip. EarthTran will make reasonable efforts to assist in recovering items found in its vehicles.

41. RETURNING LOST PROPERTY

If an item is located, reasonable shipping, courier, chauffeur, delivery, or handling costs associated with returning the item may be charged to the Client.

WEATHER, TRAFFIC & EVENTS BEYOND EARTHTRAN’S CONTROL

42. SEVERE WEATHER

EarthTran may delay, modify, suspend, or cancel transportation when severe weather or unsafe road conditions make transportation unsafe or impractical. Examples include:
  • Snow
  • Ice
  • Flooding
  • Tornadoes
  • Hurricanes
  • Severe thunderstorms
  • Dangerous road conditions
When EarthTran cancels transportation for safety reasons, EarthTran may offer an appropriate refund or travel credit depending on the circumstances, costs incurred, and applicable law.

43. TRAFFIC AND ROAD CONDITIONS

EarthTran makes reasonable efforts to arrive on time but cannot guarantee travel times. Transportation may be affected by:
  • Traffic congestion
  • Accidents
  • Construction
  • Road closures
  • Police activity
  • Security restrictions
  • Sporting events
  • Concerts
  • Conventions
  • Airport congestion
  • Government actions
  • Weather
  • Other circumstances outside EarthTran’s reasonable control
Clients traveling to time-sensitive destinations should allow adequate travel time.

44. FLIGHTS, CRUISES, TRAINS & OTHER CONNECTIONS

EarthTran is not responsible for a missed:
  • Flight
  • Train
  • Cruise
  • Meeting
  • Wedding
  • Appointment
  • Event
  • Connection
when the missed connection results from circumstances outside EarthTran’s reasonable control. Clients are responsible for selecting pickup times that provide adequate travel time.

MECHANICAL ISSUES & SUBSTITUTE VEHICLES

45. VEHICLE SUBSTITUTION

EarthTran may substitute a comparable vehicle when the originally scheduled vehicle becomes unavailable because of:
  • Mechanical problems
  • Accident
  • Maintenance issue
  • Safety concern
  • Operational emergency
  • Other circumstances beyond reasonable control
When reasonably possible, EarthTran will attempt to provide a vehicle with comparable passenger capacity and service level.

46. MECHANICAL FAILURE

EarthTran will make reasonable efforts to maintain vehicles in proper operating condition. If a mechanical problem occurs during service, EarthTran may attempt to:
  • Repair the vehicle;
  • Provide a replacement vehicle;
  • Arrange alternate transportation; or
  • Provide another reasonable remedy.
Any refund or adjustment will depend on the circumstances and the portion of transportation actually provided.

REFUNDS & SERVICE COMPLAINTS

47. NO REFUND AFTER COMPLETED SERVICE

Once contracted transportation has been fully performed, the service is generally non-refundable. No refund will normally be provided for unused time on an hourly reservation.

48. SERVICE COMPLAINTS

A Client requesting a refund or adjustment based on alleged inadequate service should contact EarthTran directly. EarthTran may investigate using information including:
  • GPS records
  • Dispatch records
  • Reservation records
  • Chauffeur reports
  • Telephone records
  • Emails
  • Text messages
  • Flight information
  • Vehicle information
  • Photographs
  • Video
  • Other relevant records
Making a complaint does not automatically entitle the Client to a refund.

49. FAILURE TO PROVIDE SERVICE

If EarthTran completely fails to provide contracted transportation and no reasonable substitute service is provided, EarthTran may refund amounts paid for transportation that was not provided. The specific remedy will depend upon the circumstances and applicable law.

PAYMENT DISPUTES & CHARGEBACKS

50. BILLING QUESTIONS

Clients should contact EarthTran directly as soon as reasonably possible regarding a suspected billing error. EarthTran should be given a reasonable opportunity to investigate and attempt to resolve the issue.

51. CHARGEBACKS

Clients agree to make a good-faith effort to address legitimate billing disputes directly with EarthTran before initiating a chargeback or payment dispute. Nothing in these Terms eliminates consumer rights that cannot legally be waived. EarthTran reserves the right to contest a chargeback when records show that:
  • Transportation was properly provided;
  • The Client agreed to the charge;
  • The Client violated the cancellation policy;
  • A valid No Call / No Show occurred;
  • Overtime was incurred;
  • Additional authorized services were provided; or
  • Other valid charges were incurred.
EarthTran may provide the payment processor or financial institution with supporting documentation, including reservation records, contracts, GPS records, correspondence, receipts, photographs, and chauffeur reports. EarthTran reserves the right to pursue unpaid valid balances through lawful collection methods.

55. CUSTOMER ACCOUNTS

Clients who create an online account are responsible for protecting their account credentials. The Client should notify EarthTran of suspected unauthorized account use. EarthTran reserves the right to suspend, restrict, or terminate an account when reasonably necessary because of:
  • Fraud
  • Security concerns
  • Abuse
  • Illegal conduct
  • Payment problems
  • Violations of these Terms

56. FRAUD PREVENTION

EarthTran may use reasonable procedures to verify a reservation or payment. EarthTran may request identification or additional verification if a transaction appears suspicious. EarthTran reserves the right to refuse or cancel a reservation that EarthTran reasonably believes involves fraud, identity theft, unauthorized payment use, or other unlawful activity.

EarthTran does not knowingly seek to collect personal information directly from children under the age permitted by applicable law. Minors should use booking and payment features with the involvement of a parent, guardian, or authorized adult.

  • Client request
  • Operational needs
  • Emergency substitution
EarthTran will make reasonable efforts to work with appropriate transportation providers. Separate provider rules may apply when disclosed to the Client.

INTERNATIONAL USERS

63. INTERNATIONAL ACCESS

The EarthTran website is operated from the United States. Users accessing the website from outside the United States are responsible for complying with applicable local laws.

INDEMNIFICATION

64. CLIENT RESPONSIBILITY

To the extent permitted by law, the Client agrees to indemnify and hold harmless EarthTran Global Limousine, its officers, directors, employees, chauffeurs, agents, and affiliates from claims, losses, damages, liabilities, and reasonable expenses arising from:
  • Client misconduct
  • Passenger misconduct
  • Illegal activity by the Client’s party
  • Damage caused by the Client’s party
  • Violation of these Terms
  • Violation of applicable law
This provision does not require the Client to indemnify EarthTran for liability that cannot legally be shifted or waived.

LIMITATION OF LIABILITY

65. CONSEQUENTIAL DAMAGES

To the maximum extent permitted by applicable law, EarthTran and its officers, directors, employees, agents, chauffeurs, and affiliates will not be liable for indirect, incidental, punitive, special, or consequential damages arising from transportation services or use of the website. This may include, where legally permitted:
  • Lost business
  • Lost revenue
  • Lost profits
  • Missed opportunities
  • Missed meetings
  • Missed flights
  • Missed events
  • Other consequential economic losses
Nothing in these Terms limits liability that cannot legally be limited.

DISPUTE RESOLUTION

67. GOOD-FAITH DISPUTE RESOLUTION

Before beginning formal proceedings, EarthTran and the Client agree to make reasonable good-faith efforts to resolve disputes directly. Clients should contact EarthTran using the contact information provided at the end of these Terms.

68. ARBITRATION

To the extent permitted by applicable law, disputes arising out of or relating to:
  • These Terms and Conditions;
  • A transportation reservation;
  • Transportation services;
  • Payment;
  • Cancellation;
  • Website use; or
  • Other dealings between the Client and EarthTran
that cannot be resolved informally may be resolved through final and binding arbitration pursuant to applicable federal and state law. Arbitration may be administered by the American Arbitration Association or another mutually agreed arbitration provider before a neutral arbitrator. The arbitrator may award remedies permitted by applicable law. The arbitration provision is intended to survive completion or termination of the reservation agreement.

69. CLASS ACTION WAIVER

To the extent permitted by applicable law, arbitration will take place on an individual basis. Neither party will seek to bring a claim as a plaintiff or member of a class, collective, or representative action when a valid individual arbitration requirement applies. This provision applies only to the extent legally enforceable.

GOVERNING LAW

70. GEORGIA LAW

To the extent permitted by applicable law, these Terms and Conditions are governed by the laws of the State of Georgia. For disputes not subject to arbitration, the parties consent to jurisdiction in an appropriate Georgia court, subject to applicable law.

TERMINATION OF SERVICE

71. EARLY TERMINATION

EarthTran may terminate transportation without refund when the Client or a passenger:
  • Engages in illegal conduct;
  • Threatens a chauffeur;
  • Creates a serious safety risk;
  • Damages the vehicle;
  • Smokes after being instructed not to;
  • Uses illegal drugs;
  • Becomes excessively disruptive;
  • Violates applicable law; or
  • Materially violates these Terms.
The Client remains responsible for valid charges incurred before termination and any applicable cleaning or damage charges.

GENERAL CONTRACT PROVISIONS

72. ENTIRE AGREEMENT

These Terms, together with:
  • Reservation confirmation
  • Quote
  • Invoice
  • Signed contract
  • Applicable addendum
  • Written itinerary
constitute the agreement between EarthTran and the Client concerning the transportation reservation.

73. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. An invalid provision will be interpreted or modified as closely as legally possible to accomplish its intended purpose.

74. NO WAIVER

EarthTran’s failure to enforce a provision on one occasion does not waive EarthTran’s right to enforce that provision on another occasion.

75. NO PARTNERSHIP

Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency relationship between the Client and EarthTran.

76. COMPLIANCE WITH LAW

EarthTran’s performance is subject to applicable laws, regulations, court orders, governmental requirements, airport rules, and law-enforcement requirements.

77. CHANGES TO TERMS

EarthTran Global Limousine reserves the right to revise these Terms and Conditions periodically. Unless otherwise required by law, the version applicable to a confirmed reservation will generally be the version in effect when that reservation is confirmed.

CLIENT ACKNOWLEDGMENT & AUTHORIZATION

78. CLIENT ACKNOWLEDGMENT

By booking transportation, signing a contract, submitting payment, or electronically accepting these Terms, the Client confirms and agrees that:
  1. The Client has reviewed the reservation information.
  2. The Client understands the transportation service being purchased.
  3. The Client understands the total reservation price or applicable pricing method.
  4. The Client agrees to pay valid additional charges incurred under these Terms.
  5. The Client understands applicable hourly minimums.
  6. The Client understands applicable garage-to-garage billing.
  7. The Client understands applicable waiting-time charges.
  8. The Client agrees to pay applicable overtime.
  9. The Client accepts responsibility for damage caused by the Client or members of the Client’s party.
  10. The Client understands that a voluntary cancellation is generally subject to a 25% cancellation fee unless a different written contract applies.
  11. The Client understands that the 25% cancellation fee can be waived by rescheduling the transportation with EarthTran Global Limousine and converting eligible amounts already paid into EarthTran Travel Credit / Store Credit.
  12. The Client understands that once the Client voluntarily chooses the travel-credit option, the travel credit is not redeemable for cash.
  13. The Client understands that No Call / No Show reservations may be charged 100% and are generally not eligible for travel credit.
  14. The Client agrees to EarthTran’s passenger conduct, smoking, cleaning, damage, waiting-time, and overtime policies.
  15. When transportation involves a child safety seat, the Client understands that EarthTran Global Limousine and its chauffeurs do not install child safety seats or booster seats.
  16. The Client understands that the parent, guardian, or responsible adult is solely responsible for selecting, installing, inspecting, adjusting, and properly using the child safety seat and for securing the child.
  17. The Client authorizes EarthTran to charge the payment method provided for the agreed transportation service and other valid charges incurred under these Terms.
  18. The Client acknowledges that clicking an online acceptance button, submitting payment, or electronically approving a reservation may constitute acceptance of these Terms.

BY MAKING A RESERVATION, SIGNING A CONTRACT, SUBMITTING PAYMENT, OR ACCEPTING THESE TERMS ELECTRONICALLY, THE CLIENT ACKNOWLEDGES THAT THE CLIENT HAS READ, UNDERSTOOD, AND AGREED TO THE EARTHTRAN GLOBAL LIMOUSINE SERVICE TERMS AND CONDITIONS.

Important Cancellation Reminder

CANCEL YOUR RESERVATION: A 25% cancellation fee generally applies. RESCHEDULE WITH EARTHTRAN: The 25% cancellation fee is waived and eligible payment is maintained as EarthTran Travel Credit / Store Credit for future transportation.

Important Child Safety Seat Reminder

EARTHTRAN GLOBAL LIMOUSINE AND ITS CHAUFFEURS DO NOT INSTALL CHILD SAFETY SEATS OR BOOSTER SEATS. THE PARENT, LEGAL GUARDIAN, OR RESPONSIBLE ADULT IS RESPONSIBLE FOR PROPER INSTALLATION, INSPECTION, ADJUSTMENT, AND SECUREMENT OF THE CHILD.
